An Owner of an Inclusionary Zoning (IZ) Unit or Affordable Dwelling Unit (ADU) is required to file a written Notice of Availability (NOA) to notify the Department of Housing and Community Development (DHCD) of any IZ Unit(s) or ADUs that are available for rent or purchase (including new units and re-rentals).
Deadlines:
New units: The NOA must be submitted to DHCD prior to the date of submission of the Certificate of Occupancy (CoO) application to the Department of Buildings (DOB) applicable to such IZ Unit(s) or ADU(s).
Re-rentals: The NOA must be submitted to DHCD as soon as the upcoming vacancy is known and prior to any marketing or taking applications for the IZ unit(s) or ADU(s).
