IZ Exempt Covenant Process (only if receiving District or federal funding)
Properties that would normally be subject to Inclusionary Zoning as determined by the Department of Buildings (DOB) but that are receiving District or federal funding to provide affordable housing that exceeds the Inclusionary Zoning requirements during the funding period must enter into an Inclusionary Development Exemption Covenant (IZ Exempt Covenant). They must also complete an IZ Exemption Certification. See the attachments below.
